P&O Cruises - Terms and Conditions


GENERAL
All bookings are subject to these Booking Conditions and the Passage Conditions contained in this brochure, and to the availability of the appropriate accommodation at time of booking. We reserve the right to change the cabin allocated to you at any time at our discretion.

HOW TO BOOK
Simply call your local travel agent or contact us on 13 24 69 to make your booking, then complete our online booking form ‘Cruise Personaliser’ at www.pocruises.com.au or fill in the attached booking form and return to us via fax or mail. Please note, by making a reservation and paying your deposit, you will be deemed to have accepted our Booking and Passage Conditions supplied in this brochure and all other information relevant to your holiday.

When you’re ready to book, please have the following ready:
• Cruise Details - ship name, cruise number and departure date.
• Cabin Details - the grade of cabin you wish to travel in and with how many passengers.
• Personal Details - as they appear on your passport or other photo ID. deposits , payment and cruise ticketing When you’re happy with the accommodation offered and the fare quoted, you will be given a booking reference number.

Bookings must be secured by a non-refundable, non-transferable deposit of AUD200 per person (AUD100 per child) on all cruises, except Cherry Blossom R809 and Pearls of Tahiti W818 where the deposit is AUD1000 per person (AUD500 per child), Australian Odyssey R742N, Kiwi Adventure N843 and Asia cruises R810-R833 where the deposit is AUD400 per person (AUD200 per child) within 7 days of confirmation. You must complete our online booking form ‘Cruise Personaliser’ at www.pocruises.com.au or the booking form attached in this brochure at the time of paying your deposit. On receipt of your deposit, P&O Cruises will forward (via your travel agent) a deposit confirmation. The balance of all fares must be received by P&O Cruises no later than 60 days prior to your sailing. For cruises N734, N801, W801, W818, W831, R742N, R801, R809-R833, full payment must be received 90 days prior. Failure to make final payment by this date may result in your booking being automatically cancelled. Documentation will be dispatched approximately 40 days prior to sailing provided the online booking form or the booking form enclosed in this brochure has been completed and full payment has been received by P&O Cruises. Payments can be made either by cheque or credit card. An additional 1% credit card service fee will be applied to the dollar amount paid by credit card or charge card. Requests for the re-issue of documents that have already been dispatched will be subject to a minimum amendment fee of AUD55, additional fees may be applicable for the re-issue of airline tickets or vouchers.

Cancellations made before the advertised date of departure will incur the following charges per person (these are also applicable for hotel packages):

*Cruises N734, N801, W801, W818, W831, R742N, N811N All airfares are non-refundable for cancellations made inside 60 days prior to the first flight departure date; this includes airfares that are included in Fly/Cruise packages where the cancellation fee will be equal to the applicable airfares quoted on page 84. Airfare conditions listed in this brochure are subject to change without notice and will be those applicable at the time of ticketing. Your travel agent may choose to charge you a handling fee. Cancellation charges do not apply to the Passenger Movement Charge, which is fully refundable at time of cancellation. Please note that the transfer of an existing cruise booking to a new cruise is regarded as a cancellation of the first cruise booking and is subject to the applicable cancellation fees. Your deposit cannot be transferred from one booking to another.

CABIN GUARANTEES
A guarantee is P&O Cruises’ undertaking to provide a specific type of cabin and fare, so passengers can proceed with their cruise plans. A cabin number will be advised at a later date. However, we reserve the right at our discretion to change the cabin allocated to you.

CHANGES TO RESERVATIONS
P&O Cruises reserves the right not to accept replacement passengers for bookings in any grade of accommodation for which there is a waitlist. The only exception may be where a complete cabin is booked and one person in that cabin cannot travel, however this will be subject to approval. In this instance, a replacement passenger may be accepted or remaining passengers may be charged the applicable fare (see ‘FARE BASIS’). At least one of the first two passengers must remain in the booking when making a name change. An administration fee of AUD100 per person will apply for each replacement passenger accepted after deposit has been received. Please note that replacement passengers are not permitted in share bookings. It is essential that your full passport name is given to P&O Cruises at the time of booking, as any correction/ alteration to a passenger name after tickets/vouchers have been issued is subject to an AUD55 per person charge on each occasion. Additional charges may apply where changes are required to air bookings made with P&O Cruises.

CONTACTING P&O CRUISES WHEN BOOKING VIA A TRAVEL AGENCY
If you hold a booking via a travel agency it is P&O Cruises’ policy not to discuss any details of your booking with any party (including yourself) except a representative of that travel agency. If you wish to transfer the ownership of your booking from one travel agency to another travel agency/wholesaler you may be able to do so by making the request in writing to the travel agency which currently holds the booking. P&O Cruises may charge a handling fee in the event of such a transfer between agencies. Please note that the travel agency may have the right to refuse the transfer of the booking and may also charge a fee.

Air Fares
To be eligible for the airfares quoted on page 84 of this brochure you must take a full cruise and travel on flights and airlines nominated by P&O Cruises. These return economy class airfares are quoted in Australian dollars, per person, and include: GST (where applicable); all fees and taxes (except New Zealand departure tax payable at the airport); applicable fuel surcharges; transfers and baggage handling between airport and ship (and vice versa) on the day of sailing only. For Auckland and Singapore transfers are included between airport and hotel (and vice versa) if hotel is booked with P&O Cruises in conjunction with the airfare. Airline baggage restrictions apply. Airfares do not include stopover accommodation. Bookings are subject to limited availability and the applicable airline conditions apply. Airfares and conditions listed in this brochure are subject to change without notice, and we reserve the right to charge the fare applicable at the time of ticketing. Air fees, taxes and surcharges may include any and all fees, charges and taxes related to air transportation imposed by Australian and/or foreign governmental or quasi-governmental authorities, including airport facility charges, departure taxes, security taxes and surcharges, airport service charges and government inspection fees. Air fees, taxes and surcharges vary by gateway city, routing, destination and carrier. Air fees, taxes and surcharges for each gateway city are correct at time of printing. P&O Cruises reserves the right to collect any increases in air fees and taxes in effect at the time of sailing, even if the fare has already been paid in full. Children 2 to 11 years and infants occupying a seat pay the full airfare for domestic flights and 75% for international flights. Infants not occupying a seat travel free on domestic flights and pay 10% of the airfare amount for international flights. You can fly on the airline nominated by P&O Cruises on the day of your choice (subject to availability) using the airfares in this brochure as a guide and make your own accommodation arrangements but transfers and baggage handling to/from airport and ship will not be included. Additional charges may apply for flight requests which differ from our nominated flights and/or airlines. Conditions apply.

AIR TICKETING
P&O Cruises will issue, as an agent only, documentation for travel on flights and airlines nominated by P&O Cruises, subject to airline schedules and availability. Flight requests are confirmed with the airline and upon receipt of full payment by P&O Cruises. Airline rules and conditions may require non-refundable payment prior to P&O Cruises’ nominal payment conditions. P&O Cruises cannot accept any responsibility where airline schedules or seat availability necessitates overnight hotel accommodation. Alterations to flights, after flights have been booked, will be subject to a minimum amendment fee of AUD100 per person. Please note that flight amendments are subject to P&O Cruises’ booking class availability and additional charges may apply for flight requests which differ from our nominated flights and/or airlines. P&O Cruises reserves the right to pass on any additional airline charges imposed after flights have been booked.

AIR AND Hotel packages
Hotel package prices quoted per person in Australian dollars.
Hotel Prices Include:
• Accommodation in hotel as stated, or, if fully booked, P&O Cruises reserves the right to substitute the hotel with one of a similar standard.
• Hotel taxes and GST.
• Transfers and baggage handling as outlined below:

Sydney and Brisbane
– Air Packages: Transfers included between airport and ship (and vice versa) on day of embarkation or disembarkation only.
– Hotel Packages: Transfers included between hotel and ship (and vice versa) on day of embarkation or disembarkation only.
– Air and Hotel Packages: There are no transfers available between airport and hotel (or vice versa). However, transfers are provided between the hotel and ship (and vice versa) on day of embarkation or disembarkation only. Auckland and Singapore
– Air Packages: Transfers included between airport and ship (and vice versa) on day of embarkation or disembarkation only.
– Hotel Packages: Transfers included between hotel and ship (and vice versa) on day of embarkation or disembarkation only.
– Air and Hotel Packages: Transfers included between airport, hotel and ship. Packages must be supplied by P&O Cruises and run consecutively for the transfers to be available.

Important Information:
• Hotel packages close 60 days prior to departure. Changes after this time cannot be made under any circumstances.
• Hotel accommodation is limited and subject to availability, particularly in holiday and special event periods.
• General hotel room configuration is 2 double beds, however this cannot be guaranteed.

GOODS AND SERVICES TAX
All domestic flights and hotel packages include GST. N734 and W831 cruise fares listed in this brochure include GST, and purchases made on board these cruises are subject to GST.


MAKING YOUR OWN TRAVEL ARRANGEMENTS
When arranging your own connecting air travel in conjunction with your cruise, please ensure your flight arrives before the following times on the day of embarkation: Departing from Brisbane: arrive by 11am, departing from Singapore: arrive by 7pm and departing from Sydney and Auckland: arrive by midday. Ensure your return flight leaves after midday on the day of disembarkation. P&O Cruises will not be held responsible for any unforeseen circumstances that necessitate any changes to your travel arrangements.

HEALTH
Passengers’ wellbeing is our foremost concern and any recent/current physical or mental condition that may require medical attention or special treatment (including travelling with a wheelchair), must be advised to us at time of booking. In addition, we may require you to complete a pre-boarding medical questionaire. If you are travelling with any medical apparatus, please advise us in writing at time of booking so we can ensure this apparatus will operate on board and send you an information sheet. Passengers must bring sufficient quantities of any prescribed medicines to last the duration of the cruise. A booking may be refused or cancelled after deposit for anyone whose state of physical or mental health renders them, in the opinion of P&O Cruises, unfit for travel, or anyone whose condition may constitute a danger to themselves or any other passenger. Details regarding wheelchair access are available on application. You should ask your travel agent to check with P&O Cruises for details.

VACCINATION AND HEALTH ADVISORIES
We recommend seasonal influenza vaccination for all passengers. Furthermore, you are strongly advised to seek advice from either your doctor or an approved public health travel advisory service, to identify any specific vaccination or health precautions required for each port of call, e.g. World Health Organisation (www.who.org), The Department of Foreign Affairs and Trade or ‘Smart Traveller’ (www.smartraveller.gov.au/tips/travelwell.html). Some countries strictly enforce certain health requirements. Failure to comply may result in the local authorities preventing passengers from going ashore and some may impose a monetary fine or deny the ship entry into the port.

Mobility and PASSENGERS REQUIRING ASSISTANCE
P&O Cruises has certain facilities available for people with disabilities or who require assistance. Please ask your travel agent or P&O Cruises for details of such facilities if you have any special needs.

MEDICAL SERVICES
The on board medical centre is staffed by full time, registered doctors and nurses. In addition to daily centre opening hours, the medical staff, headed by the Senior Doctor, are on call 24 hours a day, seven days a week to provide medical care for both passengers and crew in the event of an emergency. Charges for medical services will be added to your on board account and you will be provided with an itemised account to submit to your insurance company. Each P&O Cruises ship is outside the scope of Australian Medicare and treatment is charged at private rates. All charges for consultations, treatments and medication, including those incurred on Australian coastal cruises, cannot be claimed on Australian Medicare. We strongly recommend that you arrange appropriate international travel insurance at time of booking. P&O Cruises is not a healthcare provider and shall not be liable for the death, injury or sickness of any passenger arising from any act or omission of doctors, nurses or other providers of medical services with respect to the treatment, advice, care or services of any kind given by such persons to any passenger. These medical providers exercise their own medical judgement and expertise.

PREGNANCY
P&O Cruises cannot accept any passenger who will have entered the 24th (or later) week of pregnancy by the end of the cruise.

DINING
Classic Dining is available on Pacific Sun and Pacific Star offering two dinner sittings (1st and 2nd) at tables of 4, 6, 8 (and 10 on Pacific Sun) where you sit at the same table each evening. Your preferred dining sitting and table size may be requested at time of booking but cannot be guaranteed. Your Choice Dining is available on Pacific Dawn, where you choose to dine when, where and with whom you like each evening. Dining reservations for a specific time in the evening at the main restaurant can only be made during your cruise on board Pacific Dawn, subject to availability. A complimentary in-cabin continental breakfast is available on all ships, but a nominal delivery charge will apply.

TIPPING
Tipping is voluntary, and at passengers’ discretion, however we are frequently asked by passengers to recommend an appropriate daily amount.

CHILDREN and age restrictions
Children are not permitted to sail if, at the time of sailing, they are less than twelve months old. Due to the limited childrens’ and teenagers’ facilities on board, there are restrictions on the number of children that can be accommodated in different age groups. Childrens’ dates of birth are required to be provided at time of booking. Once the relevant limits have been reached P&O Cruises will not be able to accept bookings for any children in the applicable age group. We cannot guarantee your child’s participation in the children’s centres. Entry will be on a first come first served basis. Children must be toilet trained to attend centres. Passengers under 18 years of age not cruising with their parents must provide a letter of consent from them when booking and must travel in a complete cabin with an adult (18 years or over). For cruises W736N, W737N, W739, N737, N738, N739, N740, R742N, R743N, R744N, any passenger under the age of 21 years at the time of cruising must travel in the same cabin as their parent or legal guardian. There must be a minimum of two full fares in each cabin before children’s fares can be applied. Infants 12 months to under 3 years are welcome to travel, however they will be required to be cared for, accompanied and supervised by a parent or guardian at all times throughout the cruise. There will be a charge for evening child-minding in the youth centre between 10pm and 1am for children 3-12 years. A parent or guardian must remain contactable and on board at all times. Children under the age of 18 years must be accompanied by a parent or guardian in the entertainment lounges. Restictions may apply for children’s access to whirlpool spas.

SCHOOL HOLIDAYS
School holidays, as indicated in this brochure, are a guide only, and may vary by state and school. For some cruises, the school holiday period may not coincide exactly with the cruise period. You are advised to check school holiday dates prior to booking.

ILLICIT SUBSTANCES
P&O Cruises reserves the right to search you and/or your luggage for any illicit substances. P&O Cruises reserves the right to deny boarding or to disembark any persons in possession of illicit substances.

ALCOHOL
To ensure the safety and comfort of all on board, we wish to advise that passengers are not permitted to take on any alcohol for personal consumption. Duty-free and personal alcohol purchased shore side, must be surrendered by passengers at embarkation or prior to boarding in any port. All alcohol will be held under bond and returned at disembarkation in the final port of call. Please note that all luggage, both hand and check-in, will be x-rayed at embarkation. At disembarkation, individuals must declare to Customs all amounts of alcohol in excess of the local Customs limits. P&O Cruises reserves the right to refuse to serve alcohol to any passenger for any reason. Passengers must be 18 years of age or older to purchase or drink alcohol or gamble on board P&O Cruises’ ships at all times. For those whose age is questionable, photo identification may be requested.

SMOKING
Certain sections of the ship are designated as ‘Non-Smoking’, including all dining areas. Smoking is not permitted in these areas nor is it permitted in any share accommodation.

TRAVEL INSURANCE
At time of deposit, it is essential that you take out comprehensive international travel insurance to cover any eventuality, including any pre-existing medical conditions and charges arising should you have to cancel your holiday plans. P&O Cruises may not be liable for lost or damaged baggage and personal property. Please arrange travel insurance with your travel agent or P&O Cruises by calling 13 24 69 (Australia) or 0800 951 200 (New Zealand).

FARE BASIS
Your cruise fare is determined by the number of passengers aged 12 months and over sharing your cabin, its location on the ship and the type of amenities offered. Your ‘total fare’ includes the cruise fare, discounts, charges, government taxes (including the Passenger Movement Charge, where applicable), airline/airport taxes (except New Zealand departure tax) and fees, hotels and supplementary airfares, which are correct at time of publication, but are subject to change without notice. Pricebreaker Discounts are available on cruises booked and deposits paid by 31 October 2007 but are subject to limited availability. P&O Cruises has set aside cabins at selected grades that are available at the Pricebreaker Discounts. Once these cabins are sold, the fare may revert to an alternative discount rate or the full brochure fare. P&O Cruises reserves the right to revert to an alternative discount or full brochure fare at any time. All other information in this brochure, including itinerary details and ground arrangements are subject to change without notice. No refunds are available when changes do occur. Your travel agent or P&O Cruises can provide up-to-date advice on any such changes.

SPECIAL PROMOTIONAL FARES
On occasions, P&O Cruises will advertise special promotional fares, and we reserve the right to release and withdraw these fares at any time. Special promotional fares are applicable for new bookings only and any person who cancels an existing booking of a previously published fare to re-book on a special promotional fare on the same or any other cruise will be subject to the cancellation fees in the CANCELLATIONS clause. Promotional fare cabins are berthed at our discretion and no specific cabin or berth requests will be taken. Cabin numbers will be advised at embarkation, and we reserve the right to change your allocated cabin at any time.

WHAT YOUR FARE INCLUDES
Most things on board – accommodation, all main meals (except food at alternative dining venues as indicated on board, drinks, bar snacks and room service menu items), entertainment and the use of the ships’ many facilities.

WHAT YOUR FARE DOES NOT INCLUDE
Shore tours; drinks; tips; meals ashore; passport/visa fees; travel insurance; vaccination costs; items of a personal nature; food from the alternative dining venues as indicated on board; bar snacks; room service menu items; hairdressing services; massage and beauty therapies; photographic services; internet facilities; video arcade games; merchandise from on board shops and florist; artworks from the art auction; some materials for selected optional activities such as handicrafts and bingo; ship-to-shore telephone and fax services; medical services; laundry and dry cleaning services; some child activity services (please see ‘CHILDREN AND AGE RESTRICTIONS’ section on this page for details); or anything not mentioned in the ‘Your fare includes’ section above. Please note: the Casino and Duty and Tax-free shops on board are open subject to local regulations.

PASSPORTS AND DOCUMENTATION
Passports are required on all cruises except the following: Queensland Week Tropique, N734 and W831; however, some form of photo ID is still required on these cruises. If you hold other than an Australian or New Zealand passport you must check with your travel agent about visa requirements. All passport and visa requirements are your responsibility. Passports and visas must be valid for a minimum of 6 months beyond the date of the cruise return. To comply with Australian Government Immigration Department requirements, it is essential that the full name (as shown on passport), date of birth and nationality of each passenger is given to P&O Cruises at time of booking.

VISAS
There are many regulations that apply to different nationalities, such as the South Pacific, and it is the responsibility of you and your travel agent to ensure that you are in possession of the necessary documents to transit the countries included in your itinerary. Please note that travel on our P&O Cruises ships will not revalidate an Australian re-entry visa.

The Booking Conditions and Passage Conditions contained in the P&O Cruises South Pacific, Queensland and Asia 1st Edition 2007-2009 brochure (issued March 2007) are the Conditions on which you book and travel on any P&O Cruises product we sell you. Please read them carefully as you will be bound by them. P&O Cruises/We/Our/Us means Carnival plc. P&O Cruises is the operator of Pacific Sun, Pacific Star and Pacific Dawn and acts as an agent for other brands within the Carnival Group in selling you its products. In entering into this contract you are contracting with Carnival plc trading as P&O Cruises. These terms and conditions must be read having regard to the provisions of the Trade Practices Act 1974 (to the extent applicable) which gives rights and remedies to consumers in relation to the supply of goods and services. The terms and conditions in these ‘Passage Conditions’ do not have the effect of excluding, restricting or modifying any applicable rights under the Trade Practices Act.

1. No agreement exists between you and P&O Cruises until we have received your deposit monies.

2. We reserve the right, if we think it necessary, to deviate from the ship’s advertised route, to delay or cancel part of, or the whole cruise, to substitute or change the ship or ports of call, to remove the ship from service, to charter out the ship/part of the ship or otherwise limit the availability of cabins, or to tow or assist any vessel or perform any similar act, in our absolute discretion or that of the Captain. In such an event P&O Cruises shall not be required to refund any portion of the fare, make any other compensation or be liable for any other consequential damage, loss, expense, loss of time or inconvenience. Accordingly, you should not make any important arrangements or meetings based on the proposed itinerary of the cruise, which may change without liability to P&O Cruises.

3. Cancellations, for whatever reason, will be subject to the following charges: 45 days or more prior to sailing, forfeiture of your AUD200 per person (AUD100 per child) non-refundable, non-transferable deposit, regardless of fare paid; between 44 and 31 days of sailing, 25% of total fare; between 30 and 15 days of sailing, 50% of total fare; 14 days or less notice or non-appearance at time of sailing, 100% of total fare. All airfares are non-refundable for cancellations made inside 60 days prior to the first flight departure date; this includes airfares that are included in Fly/Cruise packages where the cancellation fee will be equal to the applicable airfares quoted on page 84. Airfare conditions listed in this brochure are subject to change without notice and will be those applicable at the time of ticketing. Additional handling/service fees may be imposed by your travel agent. Please note that the transfer of an existing cruise booking to a new cruise is regarded as a cancellation of the first cruise booking and is subject to the applicable cancellation fees.

4. Cancellations, for whatever reason, for Melbourne Cup (N734, W831), New Year (N801, W801, R801), Australian Odyssey (R742N), Cherry Blossom N811N, Pearls of Tahiti (W818), will be subject to the following charges: 75 days or more prior to sailing, forfeiture of your AUD200 per person (AUD100 per child) or for Cherry Blossom N811N AUD1000 per person (AUD500 per child) or for  Australian Odyssey cruise R742N AUD400 per person (AUD200 per child), non-refundable, non-transferable deposit, regardless of fare paid; between 74 and 61 days of sailing, 25% of total fare; between 60 and 31 days of sailing, 50% of total fare; 30 days or less notice or nonappearance at time of sailing, 100% of total fare. All airfares are non-refundable for cancellations made inside 60 days prior to the first flight departure date; this includes airfares that are included in Fly/Cruise packages where the cancellation fee will be equal to the applicable airfares quoted. Airfare conditions listed in this brochure are subject to change without notice and will be those applicable at the time of ticketing. Additional handling/service fees may be imposed by your travel agent. Please note that the transfer of an existing cruise booking to a new cruise is regarded as a cancellation of the first cruise booking and is subject to the applicable cancellation fees.

5. We will not be required to refund any portion of your fare nor pay any expenses whatsoever including any transportation, medical or living expenses if you leave the cruise early, and any such expense which is reasonably incurred by us on your behalf shall be payable by you to us on demand.

6. We have the right to charge the fare applicable at the date of sailing. Any difference must be paid before you board the ship or commence the cruise.

7. Only one amendment to your air ticket (if applicable) is permitted provided the same class is available and will incur a minimum amendment fee of AUD100 per person.

8. It may be necessary for us or people working for us or port/government agencies to search you and/or your luggage and goods. You agree to allow such searches. P&O Cruises reserves the right to deny boarding or to disembark any person in possession of illicit substances.

9.
(i) The Captain, at all times, has the right to confine, have sedated or to put ashore any passenger whose mental or physical health, in the Captain’s opinion, warrant that passenger being put ashore or whose conduct seriously inconveniences or jeopardises the enjoyment, health or safety of any passenger or other persons. P&O Cruises shall not be liable for such actions or for any loss incurred (including repatriation expenses) and refunds are not payable. Any expense incurred by us under this clause shall be payable by you to us on demand.
(ii) By entering into this agreement you consent to P&O Cruises receiving any medical information and documentation resulting from you consulting the on board Medical Department, and to P&O Cruises disclosing these internally as well as to external advisors and insurers.
(iii) At the time of paying your deposit, we strongly recommend that you obtain valid comprehensive international travel insurance covering you for the duration of the cruise. By entering into this agreement you agree to provide proof of this insurance to P&O Cruises if requested. You should carry a copy of the policy with you on your cruise holiday.
(iv) You consent to P&O Cruises monitoring all public areas of the ship by CCTV and the viewing, recording, retention and utilisation of such recordings by P&O Cruises’ ship and shore based personnel and or P&O Cruises’ external advisors. P&O Cruises shall not be liable for any consequences of the viewing, recording, retention and or utilisation of such recordings or for any loss or damage howsoever arising as a result.

10. Subject always to our right to limit liability under applicable law or Convention:
(i) We shall not be liable for the death, injury or sickness of any passenger however arising and whether or not arising in the course of performance of the cruise, unless caused by our proven negligence in which case our liability is limited to AUD200,000.
(ii) Where the Trade Practices Act 1974 applies and it is not possible to exclude, restrict or modify any conditions, warranties or other rights implied into this contract, P&O Cruises’ liability for any breach of condition, warranty or other right is limited to supplying the relevant cruise again or the cash equivalent.
(iii) We shall not be liable for the loss of or damage to any luggage or goods, including valuables, however arising, unless caused by our proven negligence, in which case our liability is limited to AUD1,500.
(iv) Any compensation payable by us up to the limits referred to in (i), (ii) and (iii) above will be reduced in proportion to any contributory negligence by you.

11. Luggage shall be deemed to have been delivered undamaged to you unless written notice of any loss or damage is given to us within 72 hours from the date you leave the ship. Failing receipt of the written notice within 72 hours, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.

12. Except where it operates as a carrier, P&O Cruises acts only as an agent for airlines, bus companies, car hire companies, hotels, shore tour operators and boat or dive operators. Accordingly, we shall not be liable in connection with any of these principals’ services. Nor shall we be responsible for information supplied concerning any of those principals’ services. Our responsibility does not extend beyond the ship. Whenever you leave the ship, any arrangements made by or for you are undertaken entirely at your own risk.

13. Any action, claim, suit or proceeding arising out of or connected in any way with this contract or the cruise shall only be brought in New South Wales and shall be governed by New South Wales law as shall this contract. Subject to clause 11 any claim must be notified in writing to P&O Cruises within 28 days of you leaving the ship or the date you first had knowledge of the material facts giving rise to your claim, whichever first occurs. Any action, claim, suit or proceeding must be commenced within one year of you leaving the ship or of the date when you first had knowledge of the material facts giving rise to your claim, whichever first occurs. If either of these conditions is not complied with, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.

14. You agree that in entering into this contract P&O Cruises is acting as agent or trustee on behalf of the ship, its owners, its operators, the Captain, crew, any staff or agents of P&O Cruises, any charterer of the ship and any substitute ship, its owners, its operators, its Captain and crew and that all such entities and persons shall have the benefit of all rights and exemptions contained in these Passage Conditions. You undertake not to make any claim against any person or entity other than P&O Cruises and if such claim should nevertheless be made, you agree to indemnify P&O Cruises and the person or entity against whom such claim is made against the consequences thereof.
